PokeCardMaker.net provides an online tool that allows users to create custom card designs and upload content. Users may optionally order physical products based on their designs.

An account is required to upload and manage content. Browsing and general use of the Website does not require an account.

3. Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity under your account
  • Providing accurate information

We reserve the right to suspend or terminate accounts that violate these Terms.

Accounts are not automatically deleted due to inactivity.

4. User-Generated Content

4.1 Responsibility

You are solely responsible for any content you upload, including images, designs, text, and other materials.

You confirm that:

  • You own the content or have permission to use it
  • Your content does not infringe intellectual property rights
  • Your content does not violate applicable laws

Shinebrothers is not responsible for user-uploaded content.

4.2 Visibility

Uploaded content may be:

  • Public (visible to others), or
  • Private (accessible to anyone with the direct link)

Even private content can be viewed by anyone who has the link.

Uploaded content remains stored indefinitely unless deleted by you.

4.3 License to Operate the Service

By uploading content, you grant Shinebrothers a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display the content solely for the purpose of operating the Website.

You retain ownership of your content.

5. Moderation and Removal

We reserve the right to:

  • Remove content
  • Restrict visibility
  • Suspend or terminate accounts

This may occur if content violates these Terms or applicable law.

If you believe content infringes your rights, contact info@pokecardmaker.net. Valid takedown requests will be reviewed and handled appropriately.

6. Intellectual Property

6.1. Disclaimer

PokeCardMaker.net is a fan-made tool. It is not affiliated with, endorsed by, or sponsored by any third-party intellectual property owner.

Users are responsible for ensuring that their content does not infringe third-party copyrights, trademarks, or other rights.

If a rights holder requests removal of infringing material, it will be reviewed and, where appropriate, removed.

6.2. Content Moderation

User-uploaded content (including images, text, or other media) is stored by PokeCardMaker.net and may be displayed on the Website according to your privacy and visibility settings.

For safety and compliance, this content may also be sent to third-party services for moderation purposes. For example, we use OpenAI’s moderation API to help detect illegal, abusive, or infringing content. These third-party services may store or log the content in accordance with their own policies.

Users remain fully responsible for all content they upload, including ensuring it does not infringe any third-party rights or applicable laws.

7. Orders and Payments

Physical products may be ordered through the Website.

Payments are processed via Stripe. Shinebrothers does not store full payment card information.

8. Pricing and Taxes

All prices are displayed as indicated on the Website.

Applicable taxes, including VAT or IOSS where relevant, are handled in accordance with applicable law.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Shinebrothers is not liable for user-generated content.
  • Shinebrothers is not liable for indirect, incidental, or consequential damages.
  • Shinebrothers does not guarantee uninterrupted or error-free operation.

Nothing in these Terms limits liability where such limitation is not permitted under Dutch law.

10. Indemnification

You agree to indemnify and hold harmless Shinebrothers from claims, damages, liabilities, and expenses arising from:

  • Your uploaded content
  • Your violation of these Terms
  • Your infringement of third-party rights

We may suspend or terminate access to the Website at our discretion if these Terms are violated.

You may delete your account at any time.

12. Governing Law

These Terms are governed by the laws of the Netherlands.
